Accordingly, you may not sell Virtual Items for “real” money, or exchange such Virtual Items for value outside of the Game. Regardless of how acquired, Virtual Items are non-transferable to another person or Account, do not accrue interest, and are not insured by the Federal Deposit Insurance Corporation (FDIC). Except for a limited, revocable, non-transferable license to use the Virtual Items in a Game, you have no ownership or property right in or title to such Virtual Items.

    Also says right here, everything is in the EULA is subject to the jurisdiction of laws from the country the person resides. I bolded the important part. Laws of the United States of America and the State of California. It even says, that the EULA agreements will be comply with all applicable laws.


    F.Governing Law. Except as expressly stated otherwise, this Agreement shall be governed by, and will be construed under, the laws of the United States of America and the law of the State of California, without regard to choice of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.     So the question of getting these items removed is mostly mote. Yes technically Trion has ownership of the account, but the consumer has paid to have these accounts modified to have a specific service or item in this case. The only way they could reasonably get away with it is to do a complete re-launch of the game. At the current health of the game, it might not be a bad idea to clean the slate and remove the Pay to win items.

    So lets not focuse on removing the items, because to be blunt. It won't happen, and if they did and some how managed to avoid the FCC Hammer, nobody would spend money on Crates, bundles etc because of the bait & switch. Personally, I don't like the gliders. I hate how their a must have to pvp and how they were a cash item. That reminds me, I have a friend as a paralegal. Time to harass her, and get some ideas from her. Maybe I'm wrong.

    So lets focuse on how to limit the gliders in general. From my experience. Some of the game breaking from the gliders come the ability to switch gliders and spam their abilities to suddenly end up 200 meters away.

    You can't switch armors in combat from plate to cloth once your in combat. It makes sense as that would be game breaking. Perhaps having gliders treated like armor is a viable solution. You can still use your glider, but you can't switch it out and use a different gliders abilities while in combat.

    Another option is group the abilities of gliders into groups, like they did with the red dragon abilities. So if you use the ability on one glider, and its on cool down. The abilities on other gliders will also be on cool down.

    As for nerfing premium items, Trion has done it before, it's not a farfetched idea. Just very recently, the Stormwraith Kirin was nerfed and compensation was given out for it. If you want to count it, same thing happened with the Mirage Donkey back when it was broken.
